Firstly, thank you to all who expressed an interest earlier this year... way back in April.  Since then things have moved on somewhat...

In September I won a belated appeal.  FDC Law mounted "an extreme defense" (both a barrister and a solicitor) but I got my £9.25 an hour against the £1,000's? they "spent" - I guess their Client (or more likely the public coffers) had to pay for Wayman to hide behind the skirts of her Client.  If that's how you get to be "Senior Partner" in FDC Law then, by contrast... are ALL traffic wardens Saints and Heros?

You may be interested to learn that the circuit Judge wouldn't listen to any arguments based on the Law Society Rules (despite Section 42 of the Access to Justice Act 1999) - but he DID listen (in the end) to their failings under the CPR (CPD s 13.5).   I finally got a Court Order for them to deliver a more detailed "bill" - something Wayman had refused to supply either to the Law Society or myself.  Tell me, is it easy to win an appeal 14 months on? or do you need a strong case? ;-)

In their "extreme defence" first of all their Council (Duthie) tried lying to the Judge regarding that damning "heading" on their original estimate (the heading that stated they had included costs which were *NOT* my responsibility and which they had refused to explain to the Law Society or the Judge).  However, they didn't push this too far because the Judge said he was tempted to ask for a transcript.  If he had done so I'm sure Duthie would have weaseled out of it by claiming that her memory was at fault.  Yeah, Right!  It's STILL a misleading  lie as far as I'm concerned... it WAS untrue... and she IS on record... trying to mislead a Judge in a family case.  Umm, a bit "extreme" when all I wanted was a detailed bill?  There is MORE... The DCA has long sought to alter the Appeals process because Circuit Judges seldom get to see family cases.

... later, when I submitted that Wayman was in breach of the CPD the Judge looked to DUTHIE for guidance.  She sagely nodded her agreement that the CPR did NOT apply in Family cases.  It's a shame I didn't think to say "for the record Ms. Duthie is nodding her agreement" - if it hadn't been for the Family Law Benchbook this deception might have stood today.  What the Circuit Judge said in his Judgment did a great deal to restore my faith in the Court system.  Actually, I was a little disappointed - the Judge KNEW they had tried to deceive him.  If it was ME, I'd be furious.  I thought perjury was a SERIOUS matter.  On the other hand... maybe Duthie shot them in the foot after all?  I liked the Circuit Judge - not ashamed to admit he didn't know everything.

Thanks again to the "locals" who took an interest - I hope these updates are also of interest..  If it helps you give better service to your own clients then I'm happy.  I was right about the grapevine too "hi Manchester et. al" .- .  Now it's time to spread the net a little wider, open this up to the search engines and (finally) try a little site promotion.  Newcomers may wish to start below.

I will not say "enjoy the website" because sites like this do nothing to improve the image of the Legal Profession.  Put simply, the appalling conduct of one solicitor and her Firm that has led to this creation.  There are rogues in every profession... should you care?

If you are here by direct invitation then:-

  1. You are local and probably know this person and her Firm
  2. You share the same specialist area of Law
  3. Your own Firm has invested in an Internet presence.  Why?

At the very least, being aware of how this solicitor can behave may help you offer a better service to your own Clients.  Forewarned is forearmed.  Perhaps, self-regulation begins at home?  

Despite the wide criticism of Self-regulation there may be some advantages.  Perhaps one such advantage is that you can and maybe should regulate yourselves?  Your opinions count.  There are certainly advantages in targeting this site at the Legal Profession... click here for more details.

I do not expect any miracle solution... just this.  After browsing this site you may form an opinionIt is possible that you will wish to share this with someone... and that may have a result...
