My original complaint with this solicitor involves her deception over a sum in excess of £6,000, and this Firm's absolute refusal to provide any billing information, either to myself or to The Law Society. She was in breach of the Law Society Rules and the Civil Procedures Rules and the Family Practice Rules. So much for "senior partner" practicing "family law" in a "respectable Law Firm"
The Law Society refused to enforce it's own rules so I eventually returned to the Civil Courts. Wayman hired Council to "defend" - (read "avoid providing a bill"). Council lied to the Judge and tried to deceive him... in the end this became obvious and I was successful in obtaining an order for Wayman to deliver a detailed bill, something she had gone to such extraordinary lengths to avoid.
When the "bill" arrived it had been inflated to over £16,000.
The Family Practice Rules make it compulsory for parties to file costs "estimates" at every stage. These are to assist the Court in issuing further directions and in making orders for costs. Both parties SHOULD be able to rely on these "estimates" because they are almost entirely for work already completed - there is NO excuse for them to be wildly inaccurate.
So... comparing Wayman's "bill" with her earlier "estimates"
Up to and including hearing November 2002 - "estimate" £850 Vs "bill" £4,500 - "error" 530%
Up to and including hearing April 2003 - "estimate" £1500 Vs "bill" £7,500 - "error" 500%
Up to and including hearing July 2003 - "estimate" £5000 Vs "bill" £13,400 - "error" 268%
Whether this is GROSS NEGLIGENCE or further DELIBERATE DECEIT has yet to be seen, but the figures are there and clearly documented by their costs draughtsman, Nigel Long.
Whatever you think, I can only see three possibilities.. EITHER Wayman was DELIBERATELY deceitful OR she was INCOMPETENT in providing estimates and interim bills OR BOTH. What of the Courts, precedents and the LAW? - Leigh Vs Michelin Tyre - Family

Surely Wayman's Partners would have something to say about such behaviour?
Surely there are Rules and Enforcement Bodies to prevent such behaviour by greedy and self-serving solicitors?
Surely such behaviour is punishable under the Law?
I have to agree with the Police - it would be better if the referral for a criminal investigation came from The Law Society... if only the OSS would actually get on and do their job.
Warning...
Choosing a solicitor may be one of the most critical decisions you will make. A solicitor's greed, negligence or incompetence can leave you severely out of pocket. You may find that there is almost NO regulation and little you can do. When any other type of business "misbehaves" you can go to Trading Standards or a number of other independent Bodies... with a solicitor things are much more difficult...
